General Terms and Conditions
1. Scope
The following General Terms and Conditions apply to all orders placed through our online shop. Our online shop is aimed exclusively at consumers.
A consumer is any natural person who enters into a legal transaction for purposes that are predominantly neither commercial nor independent professional activity. An entrepreneur is a natural or legal person, or a partnership with legal capacity, who, when entering into a legal transaction, acts in the exercise of their commercial or independent professional activity.

2. Contracting Parties, Conclusion of Contract
The purchase contract is concluded with Loftex GmbH.

The presentation of the products in the online shop does not constitute a legally binding offer, but rather a non-binding online catalog. You can initially place our products in your shopping cart without obligation and correct your entries at any time before submitting your binding order by using the correction tools provided and explained during the ordering process. By clicking the order button, you place a binding order for the goods contained in the shopping cart. Confirmation of receipt of your order will be sent by email immediately after submitting the order.

When the contract with us is concluded depends on the payment method you choose:

Prepayment
We accept your order by sending a declaration of acceptance in a separate email within two days, in which we will provide you with our bank details.

PayPal
During the ordering process, you will be redirected to the website of the online provider PayPal. There you can enter your payment details and confirm the payment instruction to PayPal. After placing your order in the shop, we will request PayPal to initiate the payment transaction, thereby accepting your offer.

Sofort by Klarna
After placing your order, you will be redirected to the website of the online provider Sofort GmbH, where you confirm the payment instruction. This will create a contract with us.

Amazon Pay
During the ordering process, you will be redirected to the website of the online provider Amazon before completing the order process in our online shop. There you can select the delivery address and payment method stored with Amazon and confirm the payment instruction to Amazon. You will then be redirected to our online shop, where you can complete the order process. After placing your order, we will request Amazon to initiate the payment transaction, thereby accepting your offer.

3. Contract Language, Storage of Contract Text
The language available for concluding the contract is German.
We do not store the contract text.

4. Delivery Conditions
In addition to the stated product prices, shipping costs will be added. Further details on shipping costs can be found in the offers.

For deliveries to islands, an additional shipping fee of EUR 20.00 per order will be charged.

We only ship by post. Picking up the goods yourself is unfortunately not possible.

We do not deliver to packing stations.

We reserve the right to ship the ordered goods via a freight forwarding service for shipping weights of 100 kg or more. You will be informed of this by our customer service.

5. Payment
The following payment methods are generally available in our shop:

Prepayment
If you select prepayment as your payment method, we will provide you with our bank details in a separate email and deliver the goods after receipt of payment.

PayPal
During the ordering process, you will be redirected to the website of the online provider PayPal. To pay the invoice amount via PayPal, you must be registered there or first register, verify your identity with your login details, and confirm the payment order to us. After placing your order in the shop, we will request PayPal to initiate the payment transaction.
The payment transaction will be processed automatically by PayPal immediately afterward. You will receive further instructions during the ordering process.

Sofort by Klarna
After placing your order, you will be redirected to the website of the online provider Sofort GmbH. To pay the invoice amount via Sofort, you must have a bank account activated for online banking, verify your identity accordingly, and confirm the payment order to us. You will receive further instructions during the ordering process. The payment transaction will be processed immediately by Sofort, and your account will be debited.

Amazon Pay
During the ordering process, you will be redirected to the website of the online provider Amazon before completing the order process in our online shop. In order to complete the order process and pay the invoice amount via Amazon, you must be registered there or first register and authenticate yourself with your login details. There you canSelect the delivery address and payment method stored with Amazon, confirm Amazon's use of your data and the payment instruction to us. You will then be redirected to our online shop where you can complete the order process.

Immediately after placing your order, we will request Amazon to initiate the payment transaction. The payment transaction is processed automatically by Amazon. Further information will be provided during the order process.

6. Retention of Title
The goods remain our property until full payment is received.

7. Transport Damage
If goods are delivered with obvious transport damage, please report such defects to the delivery person as soon as possible and contact us immediately. Failure to file a complaint or contact us will have no consequences for your statutory rights and their enforcement, in particular your warranty rights. However, you will help us assert our own claims against the freight carrier or transport insurance.

8. Warranty and Guarantees
Unless expressly agreed otherwise below, the statutory warranty law applies.

7. Warranty For used goods, the following applies: if the defect occurs after one year from delivery of the goods, claims for defects are excluded. Defects that occur within one year from delivery of the goods can be asserted within the statutory limitation period of two years from delivery of the goods.

The above limitations and shortened time limits do not apply to claims based on damages caused by us, our legal representatives, or vicarious agents:

in the event of injury to life, limb, or health,
in the event of intentional or grossly negligent breach of duty or fraudulent intent,
in the event of breach of essential contractual obligations, the fulfillment of which is essential for the proper performance of the contract and on whose compliance the contractual partner may regularly rely (cardinal obligations),
within the scope of a guarantee promise, if agreed or
to the extent that the scope of application of the Product Liability Act applies.

9. Liability
We are always liable without limitation for claims based on damages caused by us, our legal representatives, or vicarious agents

in the event of injury to life, body, or health,
in the event of intentional or grossly negligent breach of duty,
in the event of a warranty promise, where agreed, or
to the extent that the scope of application of the Product Liability Act applies.
In the event of a breach of essential contractual obligations, the fulfillment of which is essential for the proper performance of the contract and on whose compliance the contractual partner may regularly rely (cardinal obligations), due to slight negligence on our part, our legal representatives, or vicarious agents, liability is limited to the damage foreseeable at the time the contract was concluded, the occurrence of which must typically be expected. Otherwise, claims for damages are excluded.

We are willing to participate in an out-of-court arbitration procedure before a consumer arbitration board.
